Terms of Service
1. Acceptance of Terms
By accessing or using the Preplated platform ("Service") at preplated.com or any tenant subdomain, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users including customers and sellers.
2. Description of Service
Preplated is a preorder platform that enables cottage food businesses ("Sellers") to list products and accept preorders from customers ("Customers"). BryteTech Solutions LLC provides the technology platform only and is not a party to any transaction between Sellers and Customers.
3. Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.
4. Seller Terms
Sellers using Preplated agree to:
- Comply with all applicable local, state, and federal laws including cottage food laws in their jurisdiction
- Accurately represent their products, pricing, and availability
- Fulfill orders placed through the platform or promptly refund customers for unfulfilled orders
- Pay applicable platform fees (5% per transaction on the Online Payments plan, or $29/month on the Manual Payments plan)
- Not use the platform for any illegal, fraudulent, or deceptive activity
5. Customer Terms
Customers using Preplated agree to:
- Provide accurate contact and payment information
- Pick up orders at the designated time and location
- Contact the Seller directly for order issues, modifications, or cancellations
- Understand that all sales are between the Customer and the Seller — Preplated is not responsible for product quality, safety, or fulfillment
6. Payments
Online payments are processed by Stripe. By making a purchase, you agree to Stripe's Terms of Service. Preplated charges a 5% platform fee on Online Payment transactions, which may be passed to the customer at the Seller's discretion. For Manual Payment orders, payment is made directly to the Seller via their stated method (Zelle, Venmo, etc.).
7. SMS Communications
By providing your phone number and opting in at checkout, you consent to receive SMS messages from Preplated and the Seller including order confirmations, pickup reminders, and drop announcements. Message and data rates may apply. Reply STOP to opt out at any time.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Impersonate any person or entity
- Submit false, misleading, or fraudulent information
9. Intellectual Property
The Preplated name, logo, and platform design are owned by BryteTech Solutions LLC. Sellers retain ownership of their product listings, photos, and descriptions. You may not copy, reproduce, or distribute any part of the Service without prior written permission.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PREPLATED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. PREPLATED IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF PRODUCTS SOLD THROUGH THE PLATFORM.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRYTETECH SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO PREPLATED IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. You may also terminate your account by contacting us at support@preplated.com.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ventura County, California.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes via email or a notice on the platform.
